Mary Cosby’s son, Robert Cosby Jr., had planned to fight his ex-wife’s domestic violence claims weeks before his death.
Court documents obtained exclusively by Us Weekly show that Robert Jr., 23, filed a motion against his ex, Alexiana Arian Smokoff, on February 10, accusing her of “fabricating” an alleged 2024 domestic violence incident.
“Defendant Robert Cosby and the alleged Victim were married during the time of this late reported allegation (May 18, 2024); however, the relationship deteriorated and they are now divorced. Not all divorces are amicable. It is the Defendant’s position that the alleged victim is now fabricating an incident in retaliation for a failed marriage,” the court document read.
Robert Jr. and his attorney, Clayton Simms, even suggested bringing forward charges against Smokoff, 21, including obstruction of justice and allegedly providing false information to law enforcement officers.
“Again, this list of potential charges is not exhaustive, but gives this Court an idea of some of [the] criminal charges the alleged victim could face. Salt Lake County has not provided the defense with information that alleged victim has received immunity from prosecution for any potential crimes she could be prosecuted for,” the motion continued.
Robert Jr. died on February 23, less than two weeks after the filing. Smokoff filed for divorce late last year.
According to a Salt Lake City police report obtained by Us, the alleged victim — who was only identified at the time as A.S. — reported a domestic violence incident to officers on November 23, 2025, claiming the alleged physical altercation with Robert Jr. happened in May 2024 after she “flushed his drugs down the toilet.”
She alleged that Robert Jr. became “extremely upset” before pushing and kicking her in the stomach. She then claimed he “grabbed her by the throat” and “strangled her” to the point she lost consciousness.
She stated she did not report the incident at the time to police because “Robert’s family members contacted her and begged her not to involve law enforcement.”
She then claimed she was reporting it months later because “she believes Robert could kill her.”
Due to Robert Jr.’s death, his motion is now moot, but his attorney confirmed to Us that they had planned to challenge the charges against him. (On February 5, Mary’s son was charged with felony aggravated assault and felony assault stemming from the alleged altercation.)
In Mary’s statement to police on January 9, she denied being aware of any physical altercations between her son and his then-wife. The Real Housewives of Salt Lake City star also denied calling Smokoff or even having her phone number.
“It’s unfortunate these false allegations are popping up at a time when Mary and Robert Sr. are grieving. They’re focused on healing. They’re focused on good and positive memories of their son,” Simms exclusively told Us. ”Robert Jr.’s relationship with his ex-wife was toxic and difficult. Mary has never been convicted of any crime. There are some false statements in some of those reports. Rather than address them directly, she’s just focused on grieving and moving forward in a positive way.”
Us reached out to the public defenders assigned to the case for comment from Smokoff.
Authorities confirmed to Us that they responded to an overdose call on February 23, and Robert Jr. was found dead on arrival.
His parents, Mary and Robert Cosby Sr., released a statement through their attorney shortly after his death.
“Robert Sr. and Mary Cosby are mourning the loss of their beloved son, Robert Clinton Cosby, Jr.,” Simms exclusively told Us on February 25. “His untimely passing is hard to comprehend, and the Cosbys are struggling to understand how someone so young and full of life could be gone so soon. Robert Jr.’s warm spirit, humor and kind heart will be missed.”
Robert Jr. struggled with substance abuse issues, which played out on Season 5 of RHOSLC.
Mary supported her son through his addiction and was praised for openly speaking about his struggles.
