Haley Baylee is requesting her ex-husband Matt Kalil’s lawsuit be dismissed after he sued the influencer over comments she made about his penis size.
In court papers obtained by Page Six, Baylee is requesting the presiding judge dismiss Kalil’s invasion of privacy and unjust enrichment lawsuit against her.
“Plaintiff’s complaint seeks to hold a woman in the public eye civilly liable for providing a truthful, autobiographical account of sexual trauma she suffered and described as having led to the end of a highly publicized celebrity marriage with an NFL football star,” the court papers read.
Baylee, 33, explained in the court filing how she appeared in a livestream interview with content creator Marlon Garcia in November 2025, where she spoke “extensively and candidly” about her marriage to the former NFL player.
She described her relationship with Kalil, 36, as a “loving union that was ultimately hindered by an unfortunate physical incompatibility.”
“Far from disparaging the Plaintiff, Defendant repeatedly praised his character and the quality of their marriage throughout the interview,” the court papers continued. “She unequivocally described the Plaintiff as ‘the greatest guy in the world.”
The model added that they divorced over a “specific anatomical incompatibility that rendered a normal sexual relationship impossible.”
The court docs then explain the couple made “desperate, years-long efforts to overcome this physical barrier and save their marriage.”
She claimed Kalil’s lawsuit “ignores the dominant theme of the speech and instead attempts to isolate the narrow subset of statements concerning the size of Plaintiff’s genitalia, asserting that those remarks were offensive and treating them as though they constituted the entirety of what was communicated.”
Baylee argued her comments are of public concern, as the “choice to speak through a modern public square reflects an intent to reach a broad public audience, a consideration that weighs in favor of a public concern finding.”
The influencer alleged courts have “long recognized that the romantic relationships of celebrities fall within the scope of matters of public concern, rather than purely private affairs. That principle applies with equal force to the partners of public figures, who, by virtue of the relationship, enter the public concern.”
She went on to explain that a “later withdrawal from public life,” referring to Kalil alleging he is a private figure, “does not retroactively transform such events into private facts.”
Baylee continued that the First Amendment “protects truthful autobiographical speech, speech describing
sexual trauma, and speech about the relationships of public figures.”
“The motion to dismiss should be granted,” she requested.
A judge has yet to rule on Baylee’s request.
Reps for Kalil did not immediately respond to Page Six’s request for comment.
Baylee blamed their 2022 divorce on Kalil’s penis size in the November 2025 Twitch stream.
“We were trying to do the damn thing and [putting in work in their marriage],” she told the streamer.
“Deadass … for our whole marriage, deadass,” Baylee added. “But I was going to try it all. We tried it all: therapist, doctors. Not even lying … Looked up lipo-type s–t … That’s why it’s kinda funny. It’s like my life is a comedy, and it kinda writes itself. That was the biggest factor.”
The model compared Kalil’s penis size to “two Coke cans stacked on top of each other, maybe even a third.”
She ended, “We’ve tried, impossible unless you’re going to be in tears.”
Kalil responded to his ex-wife’s claims in a lawsuit filed earlier this month.
In the court filing obtained by Page Six, he claimed her “degrading and deeply personal comments” caused him “unwanted attention and invasive commentary from the public.”
The former Minnesota Vikings player claimed his wife, Keilani Asmus, received “disturbing” and “alarming” messages after the comments were made.
“Defendant shared these sensitive personal details about Plaintiff as entertainment for viewers and for her own financial gain even though Plaintiff reasonably expected they would remain private,” the lawsuit read. “Defendant’s choice to discuss such personal matters that were of no legitimate public concern was extreme, outrageous, and beyond all possible bounds of decency.”
He claimed to have suffered “severe emotional distress, humiliation, reputational damage and mental anguish” and is requesting $75,000 in damages.
Kalil and Baylee married in 2015 before divorcing in 2022.
