Former NFL player Matt Kalil plans to appeal after a judge dismissed his lawsuit against his ex-wife, Haley Baylee, over her candid comments about their sex life and his anatomy.
“We are not going to comment at this time other than to say we intend to appeal this decision,” Kalil’s attorney, Ryan Saba of Rosen Saba LLP, exclusively told Page Six.
A judge ruled Thursday that Baylee’s remarks were protected because she was speaking about her own life, marriage and divorce — matters the court found to be of legitimate public concern.
Baylee, 34, meanwhile, celebrated the dismissal, telling TMZ she was “so relieved this is over” and that she hoped the ruling would encourage women to speak openly about their experiences. Her attorney, Matthew Bialick, said they were “very pleased” the court dismissed every count against her.
The legal battle began after Haley discussed her nearly seven-year marriage to Kalil, 37, during a Nov. 2025 livestream with internet personality Marlon Garcia.
During the conversation, the influencer and Sports Illustrated model spoke candidly about their sex life and said intercourse with her then-husband would leave her “in tears.” She also compared his penis to “two Coke cans, maybe even a third.”
Baylee also claimed that Kalil’s penis was “like .01 percent of the population.”
“We’ve tried, impossible unless you’re going to be in tears,” she continued.
The former offensive lineman filed suit in January, accusing Haley of invasion of privacy and unjust enrichment. He alleged that her comments resulted in widespread ridicule and unwanted attention for him and his family.
He also claimed Baylee benefited financially from the renewed attention surrounding the livestream, while alleging that his new wife, Keilani Asmus, received disturbing messages as the comments continued to circulate.
The model subsequently asked the court to dismiss the case, arguing that her comments were part of a truthful, autobiographical account of her own marriage and experiences. Kalil’s legal team previously pushed back, arguing that Haley had no right to publicly disclose private marital and sexual details for financial gain.
Baylee and Kalil first began dating after he was drafted 4th overall by the Vikings in 2012.
Baylee filed for divorce from the ex-athlete in May 2022, citing irreconcilable differences.
In April 2024, Kalil, who has since retired from the NFL, married Asmus, a model. The couple welcomed a son later that year.
For now, the case is dismissed — but Kalil’s legal team isn’t ready to let the matter rest.
