90210 star Ian Ziering has been accused of battery in a new lawsuit filed against him by one of the bikers involved in his 2023 roadside brawl.

On December 31, 2023, Ziering, 60, was seen on video clashing with a group of mini-bike riders on Hollywood Boulevard. 

Two of the bikers were later arrested and the Sharknado star claimed he ‘was approached aggressively by one of these riders leading to an unsettling confrontation.’ Video also surfaced seemingly showing Ziering starting the fight.

Now one of the bikers who was arrested has filed a lawsuit against the actor.

In a civil complaint filed in LA County and reviewed by People, Jacob Hernandez has accused Ziering of assault, battery, malicious prosecution, intentional infliction of emotional distress, negligence and negligent infliction of emotional distress.

Hernandez accused Ziering of starting the fight, using his celebrity status to create his own narrative over what transpired in the media, and providing law enforcement with ‘misleading information’ that resulted in his arrest.

The Daily Mail has contacted representatives for Ziering for comment but have not yet heard back. 

Hernandez alleges he was riding his bike down a busy road with a friend and was attempting to change lanes when he drove and paused his vehicle in front of Ziering’s Mercedes-Benz.

The suit claims that Hernandez was ‘not impeding the flow of traffic in any way, specifically not the Mercedes’, as no traffic was moving.’

Ziering then ‘suddenly exited the car’ and allegedly started yelling at the plaintiff.

Hernandez, who was 20 at the time of the incident, refrained from responding.

The actor then allegedly moved towards Hernandez and shoved him ‘completely unprompted’.

The move allegedly caused Hernandez to topple into his friend and their bikes to fall onto the floor. The plaintiff alleges both he and his friend suffered injuries in the fight, and their vehicles were also left damaged. 

The lawsuit then claims that a ‘melee occurred between [Ziering] and multiple individuals who came to the aid of [Hernandez]’, an incident which Hernandez notes was caught on camera.

While addressing the incident the following day, Ziering said he ‘was approached aggressively by one of these riders leading to an unsettling confrontation’

‘[Ziering’s] actions were intentional, unnecessary, and posed a foreseeable risk of physical and emotional harm, which [Hernandez] in fact suffered,’ the lawsuit states.

The lawsuit accuses Ziering of using his high profile to shift the narrative about what had transpired by doing interviews with the media and leaving out facts when retelling the story on social media.

Hernandez also claims that he was arrested due to ‘misleading information provided by [Ziering] to law enforcement.’ He was held on $50,000 bail, and was released after his family submitted bail.

He later learned that the District’s Attorney had no criminal case moving forward against him at his arraignment the following month.

However, Hernandez says the fallout weighed heavily on him. 

He claims he suffered ‘significant mental health issues’ such as extreme anxiety, consistent panic attacks, and paranoia as a result of his arrest and the negative public depiction allegedly sparked by Ziering’s framing of the story.

‘[Hernandez] had his name negatively plastered in the media as a result of the public megaphone which the [Ziering] held, lying by omission in multiple interviews, making [Hernandez] out to be the aggressor,’ the lawsuit continues.

‘Hernandez] does not want to leave his home for fear of public humiliation nor open his social media applications, as [Ziering’s] story was publicized vilifying [Hernandez].’

The plaintiff has requested a jury trial in addition to compensatory damages and punitive damages.

He was one of two people arrested last year in connection with the incident. TMZ reported at the time that he was booked for felony vandalism.

Authorities reportedly cited videos of the incident, which took place at the end of 2023, as key pieces of evidence in the investigation – but none of the footage directly led them to identify the suspects.

An incident statement from LAPD investigators said that the altercation took place at around 3 pm on New Year’s Eve while Ziering and his daughter Penna were sitting in traffic in the 6800 block of Hollywood Boulevard.

‘The confrontation began between the victim and one of the minibike riders over possible damage to his vehicle,’ the statement said. ‘Three to four additional minibike riders jumped in and assaulted the motorist.’

Ziering shared a update with his fans on Instagram the day following the jarring attack.

‘Yesterday, I experienced an alarming incident involving a group of individuals on mini bikes,’ Ziering wrote on Instagram on January 1, 2024.

‘In an attempt to assess any damage I exited my car. This action, unfortunately, escalated into a physical altercation, which I navigated to protect myself.’

Ziering confirmed that he and his daughter were left ‘unscathed’ – but said that he was concerned about the ‘growing boldness’ of such groups.

He went on to say the brawl highlighted a larger issue of ‘hooliganism’ on the streets and the ‘need for effective law enforcement responses to such behavior.’

‘I have always been an advocate for standing up against intimidation and misconduct, and this incident reinforces my belief in the importance of personal and community safety,’ Ziering continued in the Instagram caption.
